The specific Tools available may change, be added, or be removed at any time without prior notice. We make no guarantees regarding the availability, accuracy, or functionality of any specific Tool. All Tools are provided on an "as-is" and "as-available" basis. You understand and agree that the Service may include communications from us, such as service announcements and administrative messages, and that these communications are considered part of your use of borealy.xyz.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of borealy.xyz and its licensors. However, by submitting User Content to borealy.xyz, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and display that User Content solely for the purpose of providing and operating the specific Tool you are using. This license terminates when you delete the User Content from our systems or cease using the Tool.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall borealy.xyz, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. borealy.xyz does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements. The Tools are provided for general informational and utility purposes and should not be relied upon for critical decisions.

7. Indemnification

You agree to defend, indemnify, and hold harmless borealy.xyz and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account; b) a breach of these Terms, or c) User Content posted on the Service.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in King County, Washington for the purpose of litigating any dispute arising from or related to these Terms or your use of borealy.xyz.
